解释论视角下污染环境罪争议问题探究

针对污染环境罪的诸多争议,在正确把握保护法益的基础上,一以贯之地寻求具体答案。承认生态学的人类中心法益观下的环境法益是本罪的保护法益,将环境法益与人类法益并列为本罪保护法益的观点,因缺乏对环境法益层次性的内在逻辑结构的认识而不具有合理性。2017年司法解释第1条的部分行为规定,通过对污染环境行为严重性的实质自然属性的规定,表明行为对于环境法益的实害结果;而部分结果规定则是通过对人身、财产等损害的判断,确认存在严重污染环境的损害后果。本罪的责任形式为故意,对过失犯的强调在很大程度上省略了对间接故意的认定。

On dispute of crime of pollution of environment from perspective of hermeneutics

In view of many disputes about the crime of polluting the environment, the specific answers are consistently explored on the basis of correctly grasping the protection of legal interests. One viewpoint treats environmental legal interest and human legal interest equally as the protection legal interest of the crime due to the recognition that the environmental legal interest is the protection legal interest of the crime under the anthropocentric legal interest view of ecology. That view point is unreasonable because it lacks the recognition of the inherent legal structure of the hierarchy of the environmental legal interest. Some of the acts in Article 1 of the 2017 Judicial Interpretation stipulate that the harmful consequences of the acts on the legal interests of the environment are indicated by the stipulation of the nature of the seriousness of the acts of polluting the environment, while some of the results stipulate that the harmful consequences of serious environmental pollution are confirmed by judging personal and property damages. The form of responsibility of the crime is intentional, and the emphasis on negligent crime largely omits the identification of indirect intent.
