商标平行进口不正当竞争认定研究

不正当竞争认定与商标侵权认定彼此独立,但二者关系依旧存在争议。司法机关处理二者关系及不正当竞争认定的方式存在问题。在以反不正当竞争法规制商标平行进口具有必要性的情形下,提出商标平行进口不正当竞争认定的要件,即主体要件、违法要件和效果要件,并对商标平行进口不正当竞争认定提出相关建议。

The ways of dealing with the relationship between them and identification of unfair competition still have some problems in court. Under the circumstances that it is necessary to regulate the trademark parallel import with the anti-unfair competition law, the conditions of identification of unfair competition of trademark parallel import are put forward, namely, the subject condition, the illegal condition and the effect condition. And the relevant suggestions are put forward for the identification of the unfair competition of the trademark parallel import.
