清代旗人的法律特权地位

为保护旗人的特殊利益,清朝统治者在法律上赋予旗人以特权地位。这种特权地位既表现为旗人犯罪其审判机构的专有性,也表现为其法律内容规定中的减轻处罚或特别规定。但随着八旗子弟的堕落,清朝统治者对律例的许多条款作了修改,使旗人的法律特权地位有所削弱,但实际上清朝统治者对旗人尤其是宗室觉罗犯罪的优容从未停止过。

The Privilegein Law of Qing Dynasty's Bannermen

In order to protect the special benefits of Bannermen,the governors of Qing Dynasty vested them with privilege and noble status,which is not only showed by the special judicial organization for their crime,but also by the reduction and estraordinary regulations in the content of the law.But as the degeneration of Bannermen day by day,the governors had to amend several items in law,which had weakened the legal status of Bannermen.Actually,the governors had never stopped pardoning the imperial clansmen's criminals.
