| 摘 要： | 公诉权作为检察权的主要权能之一,在检察机关的工作中举足轻重,但是关于公诉权的性质和归属问题,历来争议较大。公诉权的性质界定取决于两个方面:一是公诉权在国家权力结构中的定位;二是公诉权的运作特征和表现。无论从公诉权在国家权力结构中的定位,还是从公诉权的运作特征和表现分析,法律监督均是公诉权的本质属性。公诉权的具体配置和实际运作应当以实现公诉权的法律监督属性为原则和目标。但是,由于司法理念认识上的偏差和立法的不完善,公诉权在权力配置和实际运作中存在着诸多缺陷与问题,导致公诉权的行使未能回归理性状态。针对公诉权在配置和运作中存在的缺陷与问题,应当更新公诉理念、扩充公诉裁量权的范围、增设附条件不起诉制度、健全撤回起诉制度、赋予检察机关民事行政公诉权和完善量刑建议制度。
