| 摘 要： | 政府俘获是经济主体通过贿赂权力主体,从而操纵法律、法规、法令和政策的制定和执行,以实现自身利益的行为。政府俘获是商业贿赂的一种重要表现形式,商业贿赂是政府俘获的重要手段。我国治理商业贿赂面临着公权力对私权利的侵犯与私权利对公权力的侵蚀二元并存和当前的治理实践与国际反商业贿赂的趋势无法有效契合两大难题。运用政府俘获理论,通过确保公权力的主导地位和阻断私权利主体对公权力主体的贿赂行为与影响,培养健康的商业文化,加强对跨国企业的监管以及通过对中国经济主体海外商业贿赂行为的法律规制,将会使我们对商业贿赂的治理取得明显的成效。
