论我国劳动争议调解制度的完善

通过调解解决劳动争议有利于劳动争议的及时、彻底解决,有利于节约司法资源和劳动关系的和谐。但我国现行劳动争议调解制度存在着许多问题,比如企业劳动争议调解委员会的中立性难以保证等,制约了劳动争议调解制度的功能发挥。对此要整合现有资源,成立专门的劳动争议调解委员会,明确调解协议的效力,并采取措施促进现有调解组织功能的发挥。
