论投放虚假危险物质罪--以案例分析为视角

刑法修正案(三)第8条(刑法第291条之一),增订了投放虚假危险物质罪。本罪 的犯罪客体既不同于刑法第114和115条投放危险物质罪的公共安全,也不同于刑法第290条 和第291条的社会秩序,而是社会心理秩序。投放行为既可以针对特定的人实施,也可以针 对不特定的人实施;虚假危险物质不能从正面理解,只能从反面理解,只要不属于投放危险 物质罪中的危险物质,即可属于本罪的虚假危险物质,其特征是可信性,具有扰乱社会秩序 的可能性,但没有引起公共安全危险的可能。

On the Crime of Spreading False Dangerous Substances--In the Perspective of Case Analysis

Article 8 of the Amendment III to the Criminal Law of the People's Republic of China (Articles 291-1 of the Criminal Law) added a crime, viz. spreading false dangerous substances. Criminal act of this type not only differs from that of spreading dangerous substances as postulated in Articles 114 & 115 regarding public security, but also differs from that of creating social disorder as postulated in Articles 290&291. Instead, the crime of spreading false dangerous substance creates a social psychological disorder, in which the spreading acts may either aim at a specific individual or at unspecific persons. Therefore, the nature of the false dangerous substance ought to be interpreted in terms of its negative side than positive. If it does not fall into the category of dangerous substances, then it ought to be categorized as the false dangerous substance, characterized with credibleness, a possibility of disrupting the social order and the impossibility of creating a real threat to public security.
