| 摘 要： | 大局是指国家政权在特定历史时期的核心任务,法治必须服从和服务于大局是人类法治文明的一般规律,众多法学流派对此存在共识。服务大局是当代中国法治的重要使命,其包括如下几个方面的内容:确立中国法治的话语权、催生以人为本的价值观念、促进社会和谐稳定、实现协调和持续发展。法治服从大局的基本途径是:兼顾法律效果与政治后果,综合运用法律、政策等多种手段,加强政治参入与协商民主。
