借鉴香港法律之比较研究

本文对借鉴香港法律中的若干问题作了比较研究。文章首先扼要论述了香港法律三个组成部分与英美法系的历史联系及其特色,着重分析了战后西方国家和某些地区的法律社会化思潮对香港法律的影响,指出了香港法律中有关社会保障、劳动保护、环境保护等一系列社会立法,既要看到其资产阶级性质不会改变,同时也要看到由于一些新的历史条件,它们也会有不同程度的发展变化。文章还论述了香港作为一个现代化的国际城市,它所制订的许多法律,特别是其中涉及到经济贸易等方面的法律,不能不包含有国际影响及其发展动向,这正是香港法律的优势,也正是我国对内搞活经济和对外开放改革所需要的。文章最后对如何借鉴香港法律中合理部分提出了一些看法。

A Comparative Study on How to Draw on The Experience of Hong Kong Laws

This essay conducts a comparative research on some issues concerning how todraw on the experience and useful approaches in the laws of Hong Kong,First,the writer dwells on the three component parts of Hong Kong laws,their historicalrelations with Anglo-American law system,and their own special features,withthe focus laid on the influence upon Hong Kong laws by the post-war socializationtrend of law prevaleut in the West and some other regions.In particular,the essaypoints out,though the bourgeois nature of the social laws concerning social security, labour protection,environmental protection,etc.will not changee,these laws willundergo certain development and evolution to different extents under new historicalconditions.As a modernized international metropolis,Hong Kong's laws,especiallythose concerning economy and trade,inevitably embody some international influenceand the trend of this influence.This registers the superior aspect of the Hong Konglaws and is something China needs to adopt in the course of enlivening the domesticeconomy and opening up to the outside world.Finally,the author puts forth someviews on how to utilize the scientific and reasonable part in the Hong Kong laws.
