论环境侵害民事责任

随着改革开放的不断深入发展,工业生产发展迅速,环境问题越来越突出。由环境污染和破坏引发的民事纠纷日益增多。作为承担环境侵害的法律后果最主要的责任形式——环境侵害民事责任,目前已成为环境立法、司法中普遍关注的问题。但环境侵害民事责任仍存在着一些不合理的方面,要建立和完善这一制度,有必要对其进行探讨和研究。本文就其中一些热点问题谈谈我们的几点看法。

On civil responsibilitv of environmemtal damage

With the development of reform and industrial production, the environmental problem is becoming increasingly conspicuous. Civil disputes caused by environmntal pollution and damage are increasing. Being the main responsible form of law result of environmental damage, the civil responsibility for environmental damage has belome a problem paid close attention to in environ mental lagislation and administration of justice. However, there are some unreasonable respects in the civil responsibility for environmental damage. In order to estal-ish and perfect this system it is necessary to study this problem. The article deals with some hotpoints about this problem.
