| 摘 要： | 中国自清末“变法”时就出现了简易刑事程序的立法雏形,民国期间立法尤为完备,然而新中国建立后中国自近代以来的法制传承出现了断裂的局面。为了搞好当下的法制建设我们有必要重温历史、梳理中国简易刑事程序100余年来的发展历程,以发掘和利用那些被我们遗忘的“本土资源”。

| Abstract: | The embryonic form of the criminal summary procedure appeared in the"Law Reform" of latter stage of Qing Dynasty and became mature in the period of "Republic of China". However, the legal system evolution seemed ruptured after the foundation of new China. It is necessary for us to review history and comb the development of China criminal summary procedure over the past 100 years when we plan to better the construction of our legal system and explore those ignored "resources of native country". |
