中国是世界上死刑罪名最多的国家之一.然而,限制或废除死刑,早已是世界性的刑事立法趋势.就法学知识而言,死刑存废问题已被刑法哲学和犯罪学所穷尽;中国的死刑限制论和废止论对刑事立法也并未产生实效.死刑的学术研究已步入僵局.单纯研究死刑的立法技术特征,尚不为学界所充分重视.事实上,中国的死刑立法技术特征十分明显.研究死刑的立法技术特征,可以开拓学术研究视域,深入探知立法精神,为改善立法建言献策.

Characteristics of legislative techniques in capital punishment

China is one of the few countries in the world that still conduct the death punishment in the penal codes. The tendency in many countries in the world now is to give up or restrain the capital punishment in their penal codes. However, capital punishment still remains to be a hot debate topic in the academic field. In China, the debate and some studies have not produced any substantial impact on legislatures. This paper argues that, with regard to the obvious characteristics of legislative techniques in China's penal codes, a deeper research of them can provide a deeper understanding of the legislative techniques in China, and can possibly provide some help in legislative improvement.
