论我国问题金融机构接管制度的重新定位

预防、治理金融危机需要及时有效地处理问题金融机构，接管已经成为国际上处理问题金融机构的主要方式之一。目前，我国虽然初步形成关于问题金融机构接管的法律、行政法规、部门规章的制度体系，但是存在较多问题，主要根源是缺乏对接管的性质、目的和效力的准确与科学定位。我国问题金融机构接管应是以挽救为目的、临时性接收经营管理权为基本法律效力的一种行政强制措施。
