| 摘 要： | 民事审判与行政审判之间的权限划分与协调问题相当复杂,关涉主管权限划分、审理顺序、判决效力之间的协调以及权限冲突四大方面。对此,不仅国外没有统一的制度模式,而且在理论界也存在着较大争议。因此,加强对该问题的基础理论研究并加强相关立法建设实有必要。
