浅议我国对外贸易壁垒调查制度的完善——兼谈美国贸易法“301条款”之借鉴

美国贸易法"301条款"的出台,标志着美国成为世界上第一个建立贸易壁垒调查制度的国家。长期以来,它既是美国开拓海外市场和保护自身经济利益的最有力工具,又是美国应对国外贸易壁垒最重要的国内法依据之一。中国虽已初步建立起贸易壁垒调查制度,但和美国的"301条款"确立的贸易壁垒调查机制比较而言,依然差距很大。今后我们除继续遵循现有WTO规则和国内《调查规则》外,有必要借他人之长而避己之短,为今后进一步完善我国贸易壁垒调查制度乃至对外贸易法律提供借鉴。

A Brief Introduction of the Revision of Chinese Trade Barrier Investigation Mechanism——And Reference of Section 301 of US Trade Law

The implementation of Section 301 of the Trade Act of symbolizes that the USA has become the first nation to establish the trade barrier investigation mechanism.For a long time,Section 301 of the US Trade Law is the most effective tool for U.S to open up overseas market and protect its own economic benefits.It is also one of the most important bases of domestic law to deal with trade barrier conflicts with foreign countries.Although China has preliminarily set up the trade barrier investigation mechanism,it still has a long way to go compared with the American trade barrier investigation mechanism stipulated by Section 301.Besides following current WTO regulations and domestic investigation rules,we shall also learn from other countries in order to provide new references to further improve China's trade barrier investigation mechanism and foreign trade laws in the future.
