| 摘 要： | 我国古代森林资源保护的立法特征表现为其宏观价值取向的固定性——维护专制王权,微观价值取向的变化趋势——从重视经济价值向经济价值和生态价值并重缓慢过渡;其价值取向表现为义务本位;诸子学说是我国古代森林资源立法的理论根源。古代森林资源保护立法对当前我国森林资源保护有宝贵的借鉴意义。

| Abstract: | The legislation of ancient Chinese forest resources protection has been found out from many documents, works, historical data and papers. This paper makes a detailed analysis of these precious materials from both macroscopic and microscopic angles. It is concluded that the basic unit of the legislation of ancient Chinese forest resources protection starts with the notion of obligation and its theory root comes from the ancient philosophers in the Warring States and their works. Finally, this paper argues that the study on the legislation of ancient Chinese forest resources protection is of great significance for the current forest resources protection China. |
