| 摘 要： | "契约自由精神在刑事诉讼中的绝妙体现"这种说法是对辩诉交易的辩白还是解释?真正的契约自由的精神何在?在辩诉交易中,控辩双方是所谓"自由"的"交易"的唯一角色吗?被害人在这种所谓自由的契约中处于何种地位?刑事诉讼中保护被告人的权利是必需的,同时,保护被害人的权利又将如何看待?

| Abstract: | Is the statement that the spirit of contract freedom can be embodied marvelously in the process of penal litigation a defense or an explanation for the plea bargaining? Where is the spirit of contract freedom? Are the accuser and defender the only roles in the so called free exchange in the plea bargaining? What is the position of the victim in the so called free contract? It is necessary to protect the rights of defendant in the process of penal litigation. Meanwhile, how to regard the protection of the right of the victim? |
