| 摘 要： | 在刑事诉讼领域 ,被害人的权利体现为程序上的惩罚请求权和实体上的经济求偿权。在程序保护措施上 ,应以保障被告人的合法权益和国家统一行使追诉权为价值目标 ;在实体保护措施上 ,以切实实现被害人的经济求偿权为目的。

| Abstract: | In the field of criminal procedure, claims of the victim include procedural physical punishment right and substantive economical compensate right.In the aspect of procedural protection,we should aim at safeguarding the proper rights and interests of the defendant and centralizing the prosecutive power of the state. In the aspect of substantive protection,we must strive for the sake of the substantive economical compensate rights of victims. |
