完善儿童虐待防治法律问题研究

近年来,我国虐童事件层出不穷,但由于我国儿童虐待防治法律制度存在立法体系不完善、配套制度不健全等问题,无法对虐童行为进行有效防治。国外发达国家和地区在儿童虐待防治方面有很多先进经验可供借鉴,如完善的法律体系、对儿童虐待的明确界定、强制报告制度、调查和处理制度等。结合我国现实情况,可以对我国相关法律制度进行完善,从而有效防治儿童虐待,包括完善相关立法,建立强制报告制度,完善儿童收养与寄养制度,设立受虐儿童调查和处理制度,建立受虐儿童国家监护制度等。

Research on Perfecting Child Abuse Prevention Legal System in China

In recent years, child abuse events emerged endlessly in China. There are many problems in the legal system of China such as the imperfect legislative system and matching system which resulted in child abuse that can＇t be prevented and treated effectively. Foreign developed countries and regions have got much advanced experience in preventing and treating child abuse, such as perfect legal system, clear definition of child abuse, mandatory reporting system, investigation and treatment system etc. China should learn from them and perfect the legal system according to current states of China including improving related legislation, setting up mandatory reporting system, setting up investigation and treatment system and setting up national custody system etc.
