对我国宪法确立私有财产权保护原则的评析

十届全国人大第二次会议通过了宪法第四次修正案,第一次以宪法的形式确定了私有财产权不可侵犯的基本原则,这进一步提升了私有财产的法律地位,扩大了私有财产的范围,并为进一步完善私有财产的征收、征用制度提供了宪法依据。这是发展社会主义市场经济的客观需要和建设社会主义法治国家的内在要求。

Comment and Analysis on Establishment of Protection for Private Property Right in Chinese Constitution

The Forth Amendment to the constitution approved at the Second conference of the Tenth People's congress.The Amendment firstly defined established the basic principle of the protection for the private property right by the constitutional form.It further enhanced the legal position of the private property, enlarge the extent of it, and afford the constitutional basis for further improving imposition and requisition system. These are the objective demands for developing socialist market economy and the immanent request for constructing socialist constitutional country.
