民族民间文艺知识产权保护的制度设计:评价与反思

民族民间文艺的知识产权保护是一个历久弥新的法律课题。世界各国及国际组织半个世纪以来的各种法律成果,在取得若干经验的同时,在民族民间文艺范围、立法目的、基本原则、主要规则等方面依然存在诸多问题。文章提出,应把不具有知识产权意义的事项、具有准工业产权意义的事项、民族民间文艺衍生作品的创造性部分、思想等公共领域要素排出保护范围;应把保护民族民间文艺的知识产权和民族民间文艺的文化价值确定为民族民间文艺保护制度的立法目的;把激励创新原则、利益平衡原则、二分法原则、集体性原则、传统性原则确定为民族民间文艺保护制度的基本原则;把有关少数民族或其村寨确定为民族民间文艺的权利主体;将独创性、集体性、传统性确定为民族民间文艺的保护标准;务虚与务实相结合,确定民族民间文艺的权利内容与保护期限。
