| 摘 要： | 宪法与人权关系密切。宪法作为人权的保障书,其主要职能是为了保障人权。我国现行宪法是对已有人权的确认,但同时在人权的规定上仍存在不少有待完善之处。因此,要通过实施宪法,确认人权范围、确立违宪审查制度来实现宪法的人权的保障功能。

| Abstract: | Constitution and human rights links together. As the safeguarding book of human rights , the main function of constitution is protecting; human rights. Constitution is confirmation of existing human rights, but there are many defects in Chinese constitution in protecting human rights. So constitutions ' human rights protection function is realized though confirmation of human rights 'scope, and establishing the system of unconstitutional review. |
