| 摘 要： | “占有编”作为物权法的末编，从一审到七审，其内容几经易稿，争议不断，最终确定了五则条文。虽然占有制度自成一编，足显立法者的重视，但是由于立法目的错位、规则对象空无、条文表述不够严谨、重要内容缺失等原因使得该编出现许多不尽如人意的地方。

| Abstract: | As the last part of the property rights law, the Part V Possession was deliberated seven times totally. After many times arguments, it was finally confirmed with five articles. Despite the exclusive part for possession which apparently proves the recognition of the legislators, the misplacement of the purposes of the legislatio mak n, the bareness of the objectives, the laxity of the statements and the deficiency of the important content e this part are not fully up to expectations. |
