| 摘 要： | 限制与保护是票据追索权法律制度中必须处理的一对矛盾。如何正确处理好这一矛盾,使之形成良好的机制,乃是各国票据法追索权立法的价值取向。我国票据法追索权制度也应不断完善,以适应现阶段我国市场经济发展的需要。

| Abstract: | Restriction and protection is a contradiction which should be settled in Negotiable Instruments Law of the Rights of Recourse of the Bill. How to settle this contradiction and make a better mechanism is still a value orienlation of the legislation of the Rights of Recourse of the bill in every country. In our country, the institution of rights of recourse of the Bill should be made perfect in order to meet the needs of the present development of the market-oriented economy . |
