民事执行检察监督的现状及其制度改革

当前，在民事诉讼中“执行难”、“执行乱”的现象普遍存在，而检察监督又几乎处于真空状态，其原因一是部分执行主体人员的品德素质低下或主观上法律意识淡薄，二是当前执法环境和有关制度的制约所造成。为改变这种现状。维护司法公正，检察机关加强监督责无旁贷，且切实可行。为此，必须在民事执行监督制度上进行改革．明确民事执行监督的重点，规定监督的条件、权限和方式。

Current Supervision System of Civil Case Enforcement and Its Reform

It is commonly difficult to enforce a civil case judgment and procuratory supervision is almost powerless due to the low morality and law awareness of some enforcement subjects and to the restriction of the enforcement environment and system. As it is the procuratory＇s responsibility to change the situation to safeguard justice, the civil enforcement system must be reformed, priorities clarified,and conditions, power and manner of enforcement regulated.
