| 摘 要： | 文章界定了会诊的法律性质，认为会诊是民事合同行为，其兼具有非典型合同、诺成合同、要式合同、有偿合同等特征，并进一步阐述了会诊过程中医方相关民事责任问题。包括合同责任与侵权责任的归责原则、合同责任和侵权责任的类型、会诊医师的民事责任等。

| Abstract: | The article defined the legal nature of consultation that the consultation was a kind of civil contract act with the characteristics of innominate contract,consensual contract,formal contract,and onerous contract,etc.The authers demonstrated the civil liability related to the doctor in the process of consulation,including the principles of imputation of contract liability and tort liability,the type of contract liability and tort liability,and the civil liability of the consultants. |
