| 摘 要： | 无体物与有体物的分立,使知识产权成为可能,有力地推动了科技的进步。知识产权的客体又随着科技进步而不断扩张,由此造成独占与共有的权利冲突更加紧张。所以知识产权制度就在普遍和特殊之间寻求利益平衡中不断演进。

| Abstract: | The separation of the intangible objects from the tangible forecasts the establishment of the intellec- tual property system, which energetically propels the advancement of science and technology. The expansion of intellectual property objects along with the progress of science and technology brings tenser conflicts in rights concerning monopolization and community property. As a result, the intellectual property institution steadily evolves in the course of seeking after the equilibrium between the benefits at large and the benefits in particular. |
