如果将法律秩序看成是具有物之属性的运动系统,则也可利用社会动力学的原理来分析其运动状态。转型中国法律秩序的运动状态取决于作用于其上的自治之力、官治之力和政治之力的消长状况。总体上看,转型中国法律秩序,既非完全沿着集权治理的路径运动,也非完全沿着分权治理的路径运动,而是在伸缩的自治之力、合作的官治之力和妥协的政治之力的共同作用下,呈现出一种游走在集权治理和分权治理之间的运动状态。

Analysis of Dynamics of Transformational Chinese Legal Order

If treat a social legal order as movement system with material characteristics,we can analyze its movement status through theory of social dynamics.The movement status of transformational Chinese legal order lies on variation of power of autonomy,governing and politics.On the whole,neither does the transformational Chinese legal order thoroughly follow path of governance of centralization nor follow decentralization.It appears to follow the path between the both under the combined action of elastic autonomy power,cooperative governing power and compromising political power.
