| 摘 要： | 在我国,随着经济关系复杂化,利他合同越来越常见。利他合同中第三人权利内容可概括为四个方面:直接给付请求权,第三人可直接对债务人请求为给付,这是第三人权利的主要内容;损害赔偿请求权,这是第三人权利实现的重要保障;解除合同的参与权;受领给付的权利。

| Abstract: | In China,as the economic relationship is more and more complex,the third-person contract is becoming more and more common.The content of the third-person's right includes four aspects:the asking right of giving directly,which is the main aspect;the asking right of compensation for damage,which guarantees the third person's right;the partaking right in relieve of contract;the accepting right of giving. |
