水资源论证制度的立法模式选择

我国现行水资源论证制度立法面临的主要问题是立法位阶过低和适用范围狭窄，立法不足成为制约水资源论证工作顺利开展的最大障碍。加强水资源论证工作的首要措施就是加强立法，提升立法位阶，在法律法规中构建起水资源论证制度的主要框架。然而，制定专门的水资源论证条例并非是完善水资源论证立法的最优模式，会造成法律冲突和制度体系混乱。应当选择最具有可行性的立法模式，即修改现行的《取水许可和水资源费征收管理条例》，同时积极推动研究和制定规划水资源论证条例。

On Choice of Legislative Mode for Water Resource Assessment

The main problems in legislation facing China＇s water resource assessment are low legal hierarchy and narrow scope of application, which constitute the major obstacles to the system＇s development. Therefore, the primary approach to promoting the system is to build a framework in laws and administrative regulations by strengthening legislation and enhancing its legal hierarchy. However, it is not the best way at present to perfect the legal system and regulate the water resource assessment by enacting a specific law, because it may cause con- flicts of laws and chaos of different legal systems. The most feasible legislation mode is to modify the existing laws called ＂Regulation of Water Use Permit and Water Resource Fee＂. Meanwhile, further research and the promotion on the draft of ＂Regulation on Planning Water Resource Assessment＂ are also necessary.
