| 摘 要： | 把公平责任原则作为一般性的归责原则是我国《民法通则》独具特色的规定。这只是把公平责任原则上升为一般性归责原则 ,但这与国际惯例不符 ,在实务中难以操作 ,在逻辑上也与民法的基本理念相重叠和冲突。故建议采取德国法的作法 ,只针对特殊情形作具体规定。

| Abstract: | It is regulation with Chinese characteristic in the Chinese general rule of the civil law in which the impartial responsibility principle is regarded as the common responsibility assuming one.The author thinks that regarding the principle as a common responsibility assuming one is not in conformity with international practice.It is also hard to practice in reality,It logically overlaps and conflicts with the basic content of the civil law.So the author suggests to adopt Germany way to more specific regulations on some situation. |
