论黑社会性质组织犯罪的本质特征

黑社会性质组织犯罪是与黑社会犯罪、有组织犯罪既有区别又有联系的概念范畴和社会现象。黑社会性质组织犯罪是由有组织犯罪中高级组织形态社会化演变而来的 ,并向黑社会犯罪演进的雏形状态 ,但差异体现为同“形”不同“质”。其与黑社会犯罪的本质特征都体现为犯罪形态的社会化 ,但差异体现为同“质”不同“量”。 2 0 0 2年 4月 2 8日全国人大常委会通过的立法解释对黑社会性质组织犯罪的规定 ,体现了其社会化形态的特征。以此 ,我国对黑社会性质组织犯罪的打击不应只囿于刑事犯罪领域的惩治 ,而应将其上升为社会层面 ,同时强化国家和地区司法协助 ,从根本上遏制黑社会性质组织犯罪。

On the Innate Character of Organized Crime with Gang Nature

The organized crime with Gang nature is a conceptual category that differs from Gang's crime and organized crime as well as has connections with them. The organized crime with Gang nature has come from the evolution of the socialization of higher level of organized crime. The legislative interpretation provided by the People's Congress on April 28th, 2002 about the organized crime with Gang nature has embodied its character of social formation. Therefore, China's attack of organized crime with Gang character should not constrict in the criminal realm, but should raise the problem to the social level, at the same time should strengthen the state and district judicial assistance, and to fundamentally strangle the organized crime with Gang nature.
