我国犯罪构成的逻辑问题及出罪机制探析

近来主张重构我国传统犯罪构成理论转而全面移植德日刑法学犯罪论体系的"移植论"者认为,我国犯罪构成存在逻辑问题及缺乏出罪机制。我国耦合的犯罪构成理论,四个要件之间逻辑关系紧密,符合人们认识犯罪的一般规律;四要件既是积极的入罪要件,也是消极的出罪要件,具有出罪机制。"移植论"者对该问题的批判缺乏务实性和科学性。
