| 摘 要： | 伴随着网络传输技术和移动通信技术的发展，短信作为一种新的文学样式已得到普遍应用，这也就使侵犯短信作品著作权的行为变得更加普遍。从阐述短信作品的著作权及其侵权类型入手，力求在现有社会环境、技术条件和法律制度下，从技术保护和法律保护两个层面寻求短信作品著作权保护的有效途径，平衡各方利益，以实现短信作品社会效益的最大化。

| Abstract: | Message,appearing as a new form of literature,is generally used along with the development of Internet transmission technology and mobile communication technology.Simultaneously,it results in lots of behaviors to infringe the copyright of message work come out here and there.This paper begins with the copyright of expounding message works and the type of infringement.It tries to find out the effective way to protect the copyright of message work with the technology and legal system in the modern social environment in order to balance the benefits of all aspects and realize the social efficiency of message work in greatest degree. |
