| 摘 要： | 物权变动有公示生效主义和公示对抗主义之别。公示生效主义在追求物权变动的安全价值之时,泯灭了物权法作为私法的自治空间。从物权公示的对象、物权公示的效力以及未经公示物权的性质来看,物权变动的公示对抗主义立法体例更具合理性。

| Abstract: | Effective publication differs from counter publication in the transaction of real rights. The former ignores the autonomy space of the real right law as civil law while seeking to insure the safety of real right transactions. According to the object, effectiveness of the real right publication and the nature of the non-publication real right, we can say that the counter publication legislation system is more rational. |
