| 摘 要： | 交叉询问是源于英美法系的一项重要诉讼制度,它的价值主要体现在对实体以及程序正义的保障上,并且,也应反映出一定的效益要求。为了使交叉询问的作用能够得到有效的发挥,必须有相应的规则配置并严格依照法定程序进行。我国的交叉询问制度只强调交叉询问的工具性价值,而忽视了它的人权保障功能,配套的制度与规则也极不完善,交叉询问的作用受到很大限制。

| Abstract: | Cross examination is an important lawsuit system which originates from England and American legal family. Its value is mostly reflected on ensuring the justice of entity and procedure, and also on the claim of efficiency. In order to give play to the cross examination, regulations and procedure must be built. Cross examination system in our country emphasizes its tool value and ignores its ensuring human rights value. That the regulations and procedure are imperfect makes the role of cross examination be limited strongly. |
