论我国宪法学体系的创新

我国现行宪法学体系较为陈旧 ,不适应依法治国、建设社会主义法治国家的需要。以公民权利与国家权力相互关系的原理作为宪法学体系的主线 ,将宪法学的内容分为总论、国家论、公民论和典型案例分析四部分 ,以规范国家权力并保障公民权利作为各论的指导思想 ,是宪法学体系创新的重要思路

ON THE INNOVATION OF CONSTITUTIONAL LAW SYSTEM OF CHINA

The prevailing constitution lae system of China is not get well with social condition,which can not satisfy the need of construction the socialism country under-the-ruling-of-law. The principle based on the relationship between the power of state should be the main clue of the new constitutional law system;the content of new constitution law should consists of four parts:the first is the general theory,the second part is the theory on the state,the third part is the theory on the citizen,and the fourth part is the typical constitutional cases.It should be the guiding idelolgy of these parts to regulate the power of state and guarantee civil rights.
