| 摘 要： | 2 0 0 4年 3月 14日通过的宪法修正案加强了对私有财产的保护 ,并将征地区分为土地征收与土地征用两种情况。在新的征地制度中应落实宪法精神 ,改革现行土地征用程序、征用补偿的范围和标准 ,切实保证集体和农民的利益。

| Abstract: | The constitution amendment passed on March 14, 2004 has strengthened the safeguarding of private property right, and made a distinction between the land collection and the land expropriation. In the new land expropriation institution, the spirit of the constitution amendment should be carried out, the current land expropriation procedure, the compensation scope and standard should be revised to protect the collective and farmers' benefit. |
