农地习惯法对农地法制建设的意义

我国农地改革循的是一条自上而下的路径,但其成功终究离不开农民的支持,农地法制建设也不例外。农地习惯法自生自发于农村,与国家制定法相比,有较强的自然性、地域性和属人性。国家法在农村调整的范围和功能是有限的,不可能对农地关系的方方面面都作出具体详尽的规定。农地习惯法弥补了国家制定法的不足,有助于维护乡村秩序,其现实合理性不容忽视。农地习惯法对农地法制建设具有内容上的重要基础、实施过程中的补充修正、程序上的重要参照三大意义。因此在农地改革进程中,应重视农地习惯法的价值,实现农地习惯法与国家法的互动与融合。

The Significance of Farmland Conventional Law to the Construction of Farmland Legal System

Although China’s farmland reform adopted the top-down approach,it could not succeed without the support from farmers.The construction of farmland legal system is also no exception.Compared with the law of the state,farmland conventional law originated naturally in the countryside with distinct features of naturality,regionality and human nature.Due to the limited regulatory scope and functions of the law of the state,it is impossible to formulate specific regulations concerning each aspect of farmland.Farmland conventional law makes up for the deficiency and maintains the social order in rural area,whose practical rationality cannot be ignored.Additionally,farmland conventional law is significant to the construction of farmland legal system,providing it with the basic content,supplement in the implementation process and reference for procedure.Thus,in the course of farmland reform,farmland conventional law should be valued;its interaction and integration with the law of the state should be realized.
