| 摘 要： | 纯粹经济损失是欧洲法学界讨论最多的问题之一,也是民法领域的一个新兴的概念。本文在阐述纯粹经济损失的基本理论的基础上,通过对英国侵权法上有关过失引起的纯粹经济损失赔偿问题的经典案例的分析,指出英国侵权法对过失引起的纯粹经济损失原则上实行不予赔偿的做法,并对其理由进行了分析与反思,最后文章探讨了该判例法模式与类型化的处理方法对我国司法实践的借鉴意义。

| Abstract: | Pure economic loss is one of the most discussed issues in the European jurisprudential circle and is a new concept in the domain of civil law.Based on the basic theoretical principles of pure economic loss caused by negligence,this paper reveals the application of the non-compensation principle to British tort law through analyzing its typical case of pure economic loss compensation caused by negligence,then explores the reasons for application of the non-compensation principle,and finally discusses the reference meaning of the mode and the typed treatment methods in the case law to judicial practice in China. |
