管制刑适用的困境与对策

管制刑适用过程中，表现出管制刑立法过于粗糙，不仅给法官带来诸多困难，亦给执行机关增添不少困惑。建议以犯罪情节较轻、人身危险性较小集成管制刑适用条件；缩短管制刑期；建构管制最低法定刑减轻处罚制度；布局不同等次管制刑；确立单罪情形下管制刑判决可缓刑制度；设立管制刑易科拘役刑和3年以下有期徒刑制度；明确社区矫正机构为管制刑执行主体；整合管制义务条款；构筑违反管制义务分层处罚制。

Analysis on the Application of Public Surveillance Punishment

The rough legislation of public surveillance?punishment has brought many problems to judges and the executive organs in the process of application.It is suggested that public surveillance?punishment be applied to the light and less-dangerous crimes and that the term of imprisonment be shortened.Other suggestions include rule of minimum mitigation of punishment,distinguishing different degrees of punishment,rule of probationary suspension,rule of punishment under three years,clarifying community as the executive body,integrating terms of obligation,and rule of punishment for the violation of public surveillance?punishment.
