群体性事件与法治发展的社会基础

解决群体性事件,人们可采取诉诸法律的方式,但现实上却并非如此。选择不进法院的实质不在于没有法律可依,也不在于群体性事件的双方不懂法,而在于双方都认为进法院不能解决问题。因此,群体性事件数量的增长和规模的扩大虽然不可以被简单地判定为社会危机,但却说明了法治社会基础的缺失。群体性事件会随时间的流逝而很快消逝,但法治社会基础的培育却需要漫长的时间。

Mass Events and the Social Foundation of the Development of Ruling by Law

It seems that the solution to the mass events can rely on law but the fact is a different story. The persons who are involved in a mass event and do not want to go to court are not ignorant of law but believe that court cannot help them. Though the increasing number and scale of mass events cannot be simply regarded as social crises, they reveal the lack of the social foundation of ruling by law. A mass event will fade away as time goes on, but the formation of the social foundation of ruling by law will take a long time.
