论无效保证合同保证人的民事责任

论文结合我国司法实践着重探讨了下述三种·情形下（即（１）保证人不合格导致保证合同无效；（２）主合同当事人过错导致保证合同无效；（３）主合同当事人与保证人双方过错导致保证合同无效）保证人的民事责任问题。认为，保证合同被确认为无效后保证人的民事责任如何承担是个十分复杂的法律问题。探讨无效保证合同保证人的民事责任问题不仅要从保证民事行为本身进行考察，而且还必须结合主从合同关系及当事人过错诸方面进行综合且系统的分析。

ON THE GUARANTOR'S LIABILITYIN THE INVALIDITY OF GUARANTEE CONTRACT

Exemplified by judicial practice, this essay exposes the problem of guarantor's civil liability in the invalidity of guarantee contract as caused by the unqualification of the guarantor, by the fault of the party to the major contract, and by the common fault of the party to the major contract and the guarantor. The essay argues that when a guarantee contract is confirmed to be invalid, the complicated problem concerning the legal liability of the guarantor should be tackled not only by the guarantee of the civil act itself but also by a comprehensive and systematic analysis of the fault of the parties concerned and the relation between the major contract and vice-contract.
