论所有权保留买卖制度中的取回权——兼论我国取回权制度的立法构想

社会主义市场经济条件下,所有权保留买卖是一种重要的交易形式。取回权制度是所有权保留买卖制度项下的一种重要制度,它虽是一个传统的民法问题,但在我国的民事立法中还是一片空白。我国目前正在制定具有重大里程碑意义的民法典,取回权制度是民法典制定的应然内容。

On The Right of Reclaiming Systems——Also on the legislative designing of the reclaiming system in China

The reclaiming law system is an important institution affiliating the systems of trade preserving the proprietorship in socialist marketing economy.Though it's a traditional problem of civil law system,it's still blank in the civil law legislation of our country.This article aims at dealing with such problems as the characteristics,fulfiling conditions,procedures,and efficacity ect.It suggests refering "the law of assured movables trade" of our country's Taiwan district and certain foreign legislation stipulations so as to further complete the legislation of this field in our country.
