行业标准与认证中的反垄断法问题

制订行业的标准并进行认证是市场经济国家中,商会、行业协会等组织的一项重要功能,实践证明,由行业组织制定本行业的标准及进行认证比政府有着天然的优势。然而,由于商会、行业协会等组织在法律性质上属于互益性法人组织,本身均以会员制为基本的构建方式,这使得这些组织随时存在为实现会员整体利益而侵害消费者的利益或者社会公共利益的倾向。因而对于非政府组织所制定的行业标准和认证活动,需要从反垄断法的角度进行深入的研究。

The Problem of Antitrust Law of Professional Standard and the Certification

In market economic country,one of very important functions of trade union and guild is brawing trade standard and the certification.It was proved by practice that drawing trade standard and the certification by profes- sional organization have inartificial advantage than by government.However,because trade union and guild belong to mutual benefit corporation in law character,all of them adopt the membership system as basic construct manner, these organizations have the trend that neglects the consumer's benefit or social publicprofit for the member's whole benefit at any moment.So it is necessary to research for the trade standard and certification by chamber and guild from the point of view of antitrust-law deeply
