| 摘 要： | 本文把扬弃个人所有权而构造共同所有权的产权制度称为共有制。共有制的本质是一个所有权,即共同所有权,不存在“双重所有权”,现代企业的“两权分离”的本义是共同所有权与经营权分离。共同所有权的分权构造是现代企业的治理结构建立的产权基础。

| Abstract: | This paper defines the communal system as an ownership system that private ownership is abandoned and communal ownership is established. Its nature is ownership, and there is no "double ownership". In modern enterprises "power separation" refers to the separation of communal ownership from power of operation. The separated communal ownership is the basis of property right on which modern enterprise's management structure can be established. |
