论物权法框架下的船舶物权

船舶物权既具有物权的共性,又具有特殊性,对其建构应立足于船舶物权的上述特点,在物权法整体框架下进行制度上的安排。目前,我国船舶物权在一般制度和登记上均存在一定缺失,无法与《物权法》有机衔接,应当通过完善船舶物权立法予以解决。论文最后对船舶物权中是否存在船舶用益物权的争议进行了分析,并提出了作者的观点。

On the Real Right of Ship in the Framework of Property Law
