| 摘 要： | 中国正处于法治的启蒙或向往时期，法治理念的科学建构无疑具有统摄作用。法治的实质蕴含在于公平与正义，通常的论证方法是演绎推理。类比推理是英美法系通用的论证手段，应该探寻和借鉴触竞技、运动之两类而求与法治的旁通之效。

| Abstract: | China has been in its enlightenment of rule by law,t her efore the construction of the ideas of rule by law must occupy a dominate positi on without doubt.The substantive meanings of rule by law are fairness and just ice proved by the deductive method.Anology has been the key proving method of co mmon law,by which competition,movement and rule by law can be anologized togethe r in this article. |
