| 摘 要： | 在证据学理分类中，间接证据是理论分析较复杂、规则使用限制也较多的证据种类，但在间接证据的定义中存在着某些歧义与混乱。这些歧义与混乱主要归因于对直接证据、间接证据分类目的的误解、分类标准的混乱运用和间接证据特征的误读上。通过对分类标准的厘定和间接证据定义的溯源考察，可以对间接证据的定义作出一定的修正，并在此基础上正确把握间接证据的特征。

| Abstract: | Indirect evidence, with some restrictive rules, is a kind of more complicated evidence. There is divergence and confusion in the definition of the indirect evidence. It is the misunderstanding of the goal, the standard of the division and the characteristic of indirect evidence that leads to the divergence and confusion. A more accurate definition of indirect evidence can be given by analysis of the standard of indirect evidence and trace of its origin. |
