| 摘 要： | 旅游消费者合同及其消费权益保护问题日益引起全社会的密切关注。从完善旅游消费合同立法趋势出发,就旅游消费者合同中的惩罚性赔偿制度和格式条款的具体适用、旅游者精神损害赔偿请求权的正当性等方面,探讨现有相关法律制度的缺陷,并提出了完善旅游消费权益保护法的建议。

| Abstract: | Nowadays the whole society has paid increasingly close attention to the tourist contract and the protection of consumers' rights and interests.Starting from the trend of the legislation improvement of tourist contracts,the article tries to explore the defects in the laws related to the application of the punitive damage system,format clauses in tourist contracts,and the property of tourist's rights of claiming for compensation for mental injuries,and thus makes some suggestions on improving the laws to protect tourists' lawful rights and interests. |
